Step forward for Leamington takeaway's bid to stay open until early hours

A Leamington takeaway has taken a step forward in its plans to stay open into the early hours of the morning, despite the concerns of Environmental Health.

Perfinos had applied for permission to extend its opening hours until 4am on weekends and until 2am during the week.

Council officers raised concerns this would cause too much noise on Warwick Street, particularly for the flats above and around the chicken shop.

However, at a Warwick District Council licensing meeting on Monday (April 7) councillors granted the extra opening hours.

“It is vital to the success of his business,” argued Ruth Sheret, Perfinos’ solicitor.

“It is critically important that he is allowed to trade for longer hours so that he can keep his business viable.”

She continued: “It does seem rather unfair that other takeaways have been granted a licence to operate until 4am in the morning, but he is missing out because customers are directed away from his business. 

“He is very concerned about the viability of his business.”

A condition was put in place that SIA door staff will be needed to be on site, and it was agreed the Sunday hours will be reduced until 2am, rather than the 4am requested.

The business also agreed to submit a noise impact assessment.

Also speaking at the meeting on Monday, Environmental Health officer Sam Woods said: “While we appreciate this premises is situated in the centre of Leamington town surrounded by similar licenced premises which operate until the early hours, Perfinos itself is surrounded by domestic accommodation, including flats directly above. 

“We appreciate it is looking to attract customers as they come out of local clubs and licensed premises, however we would have concerns regarding noise from the public, from customers, as they are coming and going, and congregating.”

The business will need to update its planning permission before it can operate the extended opening hours.
